Resumen: O objetivo deste trabalho é chamar atenção para o uso de corpora paralelos como ferramenta alternativa na formação do tradutor jurídico, visando ao desenvolvimento da sensibilidade para a identificação dos padrões da linguagem especializada corrente no universo do Direito. No intuito de ilustrar tal utilização, trazemos aqui um estudo exploratório da Constituição Brasileira de 1988. Iniciamos nossa comunicação, colocando a linguagem jurídica no quadro teórico-metodológico em que se insere o trabalho: a Teoria Comunicativa da Terminologia, a Terminologia Textual e a Lingüística de Corpus. A seguir, comentamos quão limitado é o auxílio que os dicionários gerais e/ou especializados oferecem ao tradutor diante de um texto jurídico. Depois disso, introduzimos o conceito de corpus na pesquisa lingüística apresentamos a utilização de corpora paralelos como uma alternativa de trabalho viável para o tradutor. A fim de ilustrar a proposta, mostramos um estudo exploratório da tradução de verbos performativos desenvolvido em corpora paralelos multilíngües da Constituição Brasileira. Então, descrevemos a metodologia adotada e os materiais usados. Como conclusão, descrevemos os dados encontrados.

Resumen: The functionalist theory to translations is the result of the reorientation of mainstream translation practice towards the business environment. Globalization has lead to the rise of multinational corporations which function efficiently only when communication and cultural barriers are aided. Translation scholars (Christiane Nord, Hans Vermeer, Katharina Reiss) as well as translation practitioners (Justa Holz-Mänttäri) have identified the need to re-label the translator as an 'intercultural expert' who facilitates the exchange of information in view of an operative/ lucrative result. As many of the above-mentioned corporations are domain-oriented, it follows that the texts for translation are often domain-specific. In this study, we intend to verify whether the functionalist theory has applicability for domain-specific translations and to what extent the functionalist model may be used. For this purpose, we will examine functionalist concepts (i.e. client collaboration, translation brief, the translation-oriented-ST-analysis,potential functional deviation etc.) by applying a domain-specific filter.
