Resumen: This article provides evidence for the applicability of free translation to legal texts, based on an examination of actual cases of Japanese-to-English translation of agreements and contracts in which problems arise from literal translation. The data analysis shows that pitfalls associated with literal translation are attributable to not only the difficulty of finding terminological equivalents that inevitably arises from the differences in the Japanese and American legal and cultural systems, but also to the importance of preserving the spirit of mutual trust and cooperation that is found in Japanese business transactions. It is also postulated that general linguistic and interpretive problems inherent in Japanese-to-English translation of nontechnical texts, including redundancy, ambiguity, propensity for nonspecific statements, and the lack of linguistic clues (e.g., indicators of number), have fundamental, but not well understood, implications for legal translation. The conclusions indicate the need for an integrated approach to legal translation practice that uses both literal and free translations, taking into full account the linguistic, cultural, and legal factors at work in the translation process.

Resumen: Este trabajo se deriva del proyecto de investigación "Diseño de un tipologizador textual para la traducción automática de textos jurídicos (español/inglés/alemán/italiano/árabe)". El objetivo de dicho proyecto de investigación fue el diseño y posterior implementación de una herramienta informática capaz de generar automáticamente un determinado tipo de texto jurídico en español, inglés, alemán, italiano y árabe. Concretamente, se centró en el contrato de compraventa de bienes inmuebles, para el cual se ha elaborado una interlengua a partir de conceptos jurídicos en forma de gramática lógica subyacente y orientada hacia la creación de un generador automático multilingüe. Los capítulos de este libro son el fruto de las investigaciones realizadas en el seno del proyecto, sobre todo en lo que se refiere al establecimiento de prototipos textuales.

Repetition of the terms and their various equivalents enables readers to build up their knowledge of the legal systems, without leaving behind the all- important constraints of genre and context.

Resumen: The aim of this book is to provide an easy introduction to the understanding of Legal English. The book is in four parts. In the first and second parts, a theoretical background is provided where emphasis is place on analysing the peculiar features of this variety of ESP (English for Specific Purposes). A linguistic approach (both morphological and semantical) has been adopted, although other disciplines have also been taken into account, in particular sociolinguistics. This is so because Legal English is the jargon (despectively dismissed as «legalese») of an elite whose job is the meting out of justice. The third part deals with translation but from a theoretical point of view. By making use of (mostly) pragmatic concepts. A framework has been established to account for as many meanings in the texts as possible. The fourth section contains texts and documents, as well as introductions in most cases, illustrative of the different areas of the Law (Housing Law, Criminal Law, etc). Special care has been taken to select a wide variety of texts and documents to allow readers to enjoy an overview of Legal English at work. This section is heavily annotated. These notes provide explanations and translations into Spanish of the most difficult words, expressions and concepts.

Resumen: La variación sinonímica es un recurso habitual en los lenguajes de especialidad, especialmente en el lenguaje jurídico (Acuyo Verdejo 2004; Thiry 2009a; Barceló Martínez 2010). Dado que se trata de una estrategia semántica, una mala interpretación puede cambiar el significado del texto y las relaciones jurídicas establecidas en él; por ello, su correcta detección y manejo son fundamentales. El presente estudio pretende profundizar en la utilización de la variación sinonímica en el ámbito jurídico con el objetivo de comprender su funcionamiento en las dos lenguas de trabajo, inglés y español, y así poder establecer semejanzas y diferencias entre ellas. El estudio se llevará a cabo mediante el análisis de un corpus comparable de contratos de compraventa en ambas lenguas. Para detectar los casos de variación sinonímica en los textos utilizaremos una serie de marcadores textuales que nos permitirán establecer un listado de patrones de uso en cuanto a frecuencia, productividad, funcionamiento y relación de equivalencia creada entre los sinónimos. Los resultados nos ayudarán a entender en qué medida podría afectar la variación sinonímica a la comprensión e interpretación de los textos jurídicos y más específicamente en lo que respecta a la traducción, donde el manejo de esta estrategia puede ser clave en el correcto trasvase de significados entre el texto origen y el texto meta.
