Resumen: El presente estudio parte de una situación hipotética en la que se ha encargado la traducción jurada de un expediente de divorcio irlandés para un juez español. La traducción de carácter jurídico está influida por diversos factores que determinan las decisiones del traductor. Es primordial analizar factores como el marco legistaltivo y cronológico del documento y de su traducción, el receptor y, en este caso, las restricciones de la traducción jurada en España. Se hace necesario, por tanto, un acercamiento funcionalista por la importancia que se concede al efecto jurídico del documento. Se utilizará una tipología textual para establecer el grado de asimetría procesal entre ambos sistemas jurídicos, pues el documento en sí es considerado unidad de traducción, con el fin de establecer cuál es su función y favorecer su correcta interpretación e identificación por parte del juez.
