Resumen: Official translations are generally documents that serve as legally valid instruments. They include anything from certificates of birth, death or marriage through to academic transcripts or legal contracts. Roberto Mayoral deals with the very practical problems of official translating. He points out the failings of traditional theories in this field and the need for revised concepts such as the virtual document, pragmatic constraints, and risk analysis. He details aspects of the social contexts, ethical norms, translation strategies, different formats, fees, legal formulas, and ways of solving the most frequent problems. Care is taken to address as wide a range of cultural contexts as possible and to stress the active role of the translator.

Resumen: Hay varias corrientes de pensamiento sobre la traducción especializada. En este ámbito, encontramos aquellos traductores que han estudiado una determinada carrera, como medicina, abogacía, genética, odontología, medioambiente u otra, y luego deciden comenzar la carrera de traducción. El traductor especializado, además de conocer con certeza el tema que traduce, debe tener un amplio dominio lingüístico a fin de abordar y optimizar sus traducciones y, fundamentalmente, debe ser un gran investigador. La investigación es la base de su conocimiento para ir aumentando su competencia en el tema especializado.

Resumen: Este trabajo se deriva del proyecto de investigación "Diseño de un tipologizador textual para la traducción automática de textos jurídicos (español/inglés/alemán/italiano/árabe)". El objetivo de dicho proyecto de investigación fue el diseño y posterior implementación de una herramienta informática capaz de generar automáticamente un determinado tipo de texto jurídico en español, inglés, alemán, italiano y árabe. Concretamente, se centró en el contrato de compraventa de bienes inmuebles, para el cual se ha elaborado una interlengua a partir de conceptos jurídicos en forma de gramática lógica subyacente y orientada hacia la creación de un generador automático multilingüe. Los capítulos de este libro son el fruto de las investigaciones realizadas en el seno del proyecto, sobre todo en lo que se refiere al establecimiento de prototipos textuales.

Resumen: The aim of this book is to provide an easy introduction to the understanding of Legal English. The book is in four parts. In the first and second parts, a theoretical background is provided where emphasis is place on analysing the peculiar features of this variety of ESP (English for Specific Purposes). A linguistic approach (both morphological and semantical) has been adopted, although other disciplines have also been taken into account, in particular sociolinguistics. This is so because Legal English is the jargon (despectively dismissed as «legalese») of an elite whose job is the meting out of justice. The third part deals with translation but from a theoretical point of view. By making use of (mostly) pragmatic concepts. A framework has been established to account for as many meanings in the texts as possible. The fourth section contains texts and documents, as well as introductions in most cases, illustrative of the different areas of the Law (Housing Law, Criminal Law, etc). Special care has been taken to select a wide variety of texts and documents to allow readers to enjoy an overview of Legal English at work. This section is heavily annotated. These notes provide explanations and translations into Spanish of the most difficult words, expressions and concepts.

Resumen: Esta ponencia surge como resultado de un trabajo de investigacion sobre Traduccion y Globalizacion que realice hace unos años, y de mi tarea, de indole mas bien practica, a cargo de materias de Traduccion Juridica y Terminologia Juridica, en las Carreras de Traductorado Publico en Ingles de dos universidades. Es por eso, que tiene un componente teorico, a modo de introduccion, y otro ya mas practico que intenta reflejar el trabajo que realizo, mas algunas propuestas de trabajo concretas para el ejercicio de la docencia de la traduccion juridica. Veremos en esta primera diapositiva algunas representaciones graficas que nos ayudan a poner de relieve las relaciones entre dos mundos, dos ambitos que visualmente se presentan como disimiles. hasta antagonicos. Mas aun, como fruto de conversaciones y comentarios con algunos colegas y alumnos, la conclusion a la que podria llegar es que existe una brecha, una inconmensurabilidad entre un mundo y el otro. Tratemos pues de analizar de que modo se puede acortar esa distancia.

Resumen: La variación sinonímica es un recurso habitual en los lenguajes de especialidad, especialmente en el lenguaje jurídico (Acuyo Verdejo 2004; Thiry 2009a; Barceló Martínez 2010). Dado que se trata de una estrategia semántica, una mala interpretación puede cambiar el significado del texto y las relaciones jurídicas establecidas en él; por ello, su correcta detección y manejo son fundamentales. El presente estudio pretende profundizar en la utilización de la variación sinonímica en el ámbito jurídico con el objetivo de comprender su funcionamiento en las dos lenguas de trabajo, inglés y español, y así poder establecer semejanzas y diferencias entre ellas. El estudio se llevará a cabo mediante el análisis de un corpus comparable de contratos de compraventa en ambas lenguas. Para detectar los casos de variación sinonímica en los textos utilizaremos una serie de marcadores textuales que nos permitirán establecer un listado de patrones de uso en cuanto a frecuencia, productividad, funcionamiento y relación de equivalencia creada entre los sinónimos. Los resultados nos ayudarán a entender en qué medida podría afectar la variación sinonímica a la comprensión e interpretación de los textos jurídicos y más específicamente en lo que respecta a la traducción, donde el manejo de esta estrategia puede ser clave en el correcto trasvase de significados entre el texto origen y el texto meta.

Resumen: (...) "Translators who specialize in legal materials are expected to have a sound knowledge of the law. What, exactly, is entailed by "a sound knowledge of the law" is a subject which has not been discussed in depth. Courses of study have sometines been set up without a clear idea of the needs of students of legal translation, and so we find law courses being taught by professors who ignore such needs. Resumen: Los textos constitucionales presentan una evidente marca cultural, en tanto dan respuesta a las necesidades y aspiraciones axiológicas y organizativas de un Estado. En este trabajo se analizan, de manera contrastiva, fragmentos de textos constitucionales referidos a derechos fundamentales de Estados Unidos de América e Inglaterra, aprobados, en el primer caso, luego de la guerra de independencia (Constitución de 1787) y, en el segundo, en el contexto de la puja de poder entre la Corona y el Parlamento (Petition of Right1628 y Bill of Rights 1689). Luego de una breve presentación del contexto histórico-cultural de ambos textos, se estudian los diferentes modos en que se cristalizan las características propias del inglés jurídico de estos textos, como la presencia de elementos léxicos del latín y el francés, el registro formal y arcaizante, la redundancia expresiva, la proposiciones yuxtapuestas, etc., y los desafíos que estos rasgos implican en el proceso de traducción al español, ilustrados con ejemplos concretos. Finalmente, se examina el producto final en relación con la teoría de los actos de habla y el enfoque interaccionista, lo que permite analizar la permanencia de la intención de los constituyentes respecto del "hacer hacer", es decir, que el texto constitucional sea una fuente de inspiración para el compromiso y la acción ciudadana.

Resumen: This book explores the intricacies of court interpreting through a thorough analysis of the authentic discourse of the English-speaking participants, the Spanish-speaking witnesses and the interpreters. Written by a practitioner, educator and researcher, the book presents the reader with real issues that most court interpreters face during their work and shows through the results of careful research studies that interpreter's choices can have varying degrees of influence on the triadic exchange. It aims to raise the practitioners' awareness of the significance of their choices and attempts to provide a theoretical basis for interpreters to make informed decisions rather than intuitive ones. It also suggests solutions for common problems. The book highlights the complexities of court interpreting and argues for thorough training for practicing interpreters to improve their performance as well as for better understanding of their task from the legal profession. Although the data is drawn from Spanish-English cases, the main results can be extended to any language combination. The book is written in a clear, accessible language and is aimed at practicing interpreters, students and educators of interpreting, linguists and legal professionals.

Resumen: El inglés jurídico es un lenguaje bastante difícil. Se ha tratado de actualizar este lenguaje especializado, es decir, adaptar el inglés jurídico formal al inglés estándar para que sea más accesible. En esta cuestión existen dos posturas claramente opuestas: la de aquellos que defienden la adaptación del inglés jurídico al inglés estándar y la de aquellos que desean mantener el lenguaje especializado arcaico sin actualización porque piensan que de ese modo "existen más garantías jurídicas".

Resumen: Dada la demanda de trabajos de traducción destinados al público hispanohablante en los EE. UU. en lo tocante al ámbito de la salud, la traducción de documentos médico-jurídicos, como los consentimientos informados, exponen al traductor a un desafío lingüístico multidisciplinario donde no sólo se requiere el conocimiento de la terminología específica de las distintas áreas temáticas afines, sino que, además, es fundamental su familiarización con los principios, el propósito y las distintas formas de presentación de dicho material. En esta presentación, procuraré transmitir la lógica del consentimiento informado, sus componentes y resultados esperados, para que el traductor componga un cuadro mental precedente a la traducción, que le sirva como esquema para una investigación productiva y un trabajo satisfactorio y eficaz.
