Resumen: La traduction et l’interprétation en milieu judiciaire sont deux pratiques différentes exercées dans un même domaine, celui de la justice. Nous examinons ici la situation des experts traducteurs-interprètes. La justice française d’aujourd’hui est une justice dans l’urgence (Bastard et Mouhanna, 2007). Le traducteur doit en être bien conscient lorsqu’il reçoit une demande. Certains actes sont particulièrement urgents, notamment les mandats d’arrêt européen ou d’extradition, les ordonnances et les commissions rogatoires internationales de juges d’instruction qui sont à exécuter rapidement pour permettre l’avancement de la procédure, d’autant plus lorsque les personnes concernées se trouvent en détention provisoire.

Resumen: An examination of the existing disciplinary policies across states that are members of the Consortium for State Court Interpreter Certification reveals that there are some similarities, as well as some important differences, among these states policies. In most states, the disciplinary policies relate solely to freelance or "per diem" court interpreters. Interpreters hired as staff within the courthouse are subject to organizational human resource policies and disciplinary actions.

Resumen: This second edition revises and up-dates the first edition that was published in 1979. Like its predecessor, this manual attempts to cover the practical and most common aspects of Spanish judiciary interpreting in the U.S. courts of law only [law enforcement, drugs, felonies, misdemeanors, labor disputes, immigration issues, domestic and juvenile matters and other things people go to court for]. There are sections on motorized vehicles and anatomy for personal injury cases; however, in such cases, medical dictionaries should also be consulted, depending on the types of injuries suffered. The Dictionary portion took into account the following factors: English- and Spanish-speaking countries have two very different legal systems- common law and Roman law, respectively. Thus, it is not always possible to have a word for word equivalent, but concepts that must be interpreted; each of the more than 20 Spanish-speaking countries of the world, has its own vernacular and regionalisms- wich have to be identified and learned by the interpreter according to the geographical region in which he/she works; the southwestern states have a Spanish-speaking population that has developed its own terminology over the centuries since the Conquistadors, so "Chicano" or Mexican-American [MA] has been included when possible; street language and drug slang changes constantly, from city to city and neighborhood, but the words included herein have remained pretty constant over the last decade or two.

Resumen: Hay varias categorías de traductores o intérpretes judiciales: pueden ser personas que trabajan en la Policía, en la Fiscalía y desde luego en los Tribunales, en la Asociación de Abogados, en el Instituto de Menores, y también en los centros de ayuda judicial. El centro de ayuda judicial es una fundación del Ministerio de Justicia que ofrece ayuda legal a personas que requieren algún tipo de asistencia, y en ocasiones suelen dar préstamos o subsidios para facilitar la defensa. Por otra parte, los municipios y organismos públicos suelen tener también intérpretes en distintos idiomas para atender a los distintos requerimientos tanto nacionales como extranjeros, sobre información municipal o de la administración pública. Ellos no son considerados intérpretes judiciales pero tiene su rol y a veces pueden trabajar, por supuesto, según las necesidades del momento en la policía o en la fiscalía.

Resumen: Dans quel contexte intervient un interprète1 en milieu policier ? Je vais surtout vous parler de la situation belge, qui n’est cependant probablement pas très différente de la situation française. En effet, une directive européenne règlemente l’intervention des interprètes dans les procédures pénales : elle rend obligatoire l’assistance d’un interprète lorsqu’un suspect ne comprend pas la langue pratiquée par l’institution policière du pays où il se trouve. Il s’agit cependant d’un interprète dans une langue que le suspect comprend ou pratique, et pas forcément dans sa langue maternelle : les instances policières belges ne sont pas obligées, si elles interrogent un Letton, de lui présenter un interprète pour le letton. Si aucun interprète dans cet idiome n’est disponible et si elles constatent que le suspect comprend assez bien l’anglais, elles pourront solliciter un interprète français/anglais ou néerlandais/anglais. Il y a donc encore de la marge pour améliorer la situation et renforcer les droits du suspect – d’autant que l’évaluation de ses aptitudes linguistiques dépend entièrement d’un policier, qui souvent n’est guère compétent pour les juger. Et c’est sur la base de cette évaluation qu’un interprète est contacté.

Resumen: This book explores the intricacies of court interpreting through a thorough analysis of the authentic discourse of the English-speaking participants, the Spanish-speaking witnesses and the interpreters. Written by a practitioner, educator and researcher, the book presents the reader with real issues that most court interpreters face during their work and shows through the results of careful research studies that interpreter's choices can have varying degrees of influence on the triadic exchange. It aims to raise the practitioners' awareness of the significance of their choices and attempts to provide a theoretical basis for interpreters to make informed decisions rather than intuitive ones. It also suggests solutions for common problems. The book highlights the complexities of court interpreting and argues for thorough training for practicing interpreters to improve their performance as well as for better understanding of their task from the legal profession. Although the data is drawn from Spanish-English cases, the main results can be extended to any language combination. Resumen: Various studies have shown that the manner in which an interpreter renders a witness ́s utterances may affect how a jury perceives a witness. For example, if an interpreter were to add the pause marker uh to his or her rendition of a witness ́s testimony, jurors could perceive the witnes as being hesitant and untrustworthy, which could affect the outcome of a trial.

Resumen: La traductora e intérprete M. Eba Trabing visitó el país en octubre para dictar dos cursos en la sede del CTPCBA. Durante su visita, habló de su centro de estudios en Carolina del Norte y describió las condiciones en que se ejerce la profesión en los Tribunales Federales de los Estados Unidos. En 1991 se convirtió en la primera intérprete que formó parte de la comisión nacional de diez personas organizada por el "National Center for State Courst para designar traductores jurídicos en los tribunales.
