Pour ce faire, nous nous sommes servi de deux instruments méthodologiques : l'analyse du discours, appliquée à un corpus d'arrêts de la Cour de Cassation française, et l'analyse contrastive de textes parallèles en espagnol, en particulier des arrêts du Tribunal Supremo portant sur le même sujet et prononcés à la même époque.
